Ok, so I have heard alot about this subject. I want to know it the homebrew channel is legal for the wii. People say it is, but nintendo says:

Chapter II: Unauthorized Software, Services, or Devices or Unlicensed Accessories

Your Wii Console and the Wii Network Service are not designed for use with unauthorized software, services, or devices or non-licensed accessories, and you may not use any of these with your Wii Console or the Wii Network Service. Such use may be illegal, voids any warranty, and is a breach of this agreement. Such use may also lead to injury to you or others or cause performance issues or damage to your Wii Console or the Wii Network Service. We (and our licensees and distributors) are not responsible for damage or loss caused by unauthorized software, services or devices or non-licensed accessories. We may take steps to disable or delete any unauthorized software, services or device installed in your Wii Console, for example, by detecting and disabling them through the Wii Network Service and/or game software. If we detect unauthorized software, services, or devices, your access to the Wii Network Service may be disabled and/or the Wii Console or games may be unplayable.

So...what do you think...legal or illegal?

no is illegal i hav homebrew which is the coolest thing ever but u cant get system updates cuz if u do then the system detects homebrew and shuts down ur wii ive seen it happen and it can cause serious file dammage if u do it wrong and its really hard so i dont recommend it cuz it puts u and ur wii in great risk

Yes it is illegal, according to the Chapter, when you bought your Wii, you agreed to not use any unauthorized software, or hardware with your Wii, which breaches the contract, voids your warranty and may be illegal depending on what you used. You broke a contract you made with Nintendo. Nobody really cares, but yes its technically illegal. It also spells out consequences for using such services at the end.

The softmodding/installation of the homebrew channel itself is not illegal, but it is against the EULA of the Wii console, and therefore voids your warranty, so it's not a good idea if your warranty is still intact (though I think by now the warranty on all Wii consoles, excluding the U and Mini, are void by this point)



However, it is illegal to use the homebrew channel (and other softmods) to pirate games, as it is considered as theft

The wii softmod in itself is not illegal. It is legal to insert apps and channels into your wii. The only thing thats illegal is to use it to run burned games (which most people do)

i have it, i beleive it is legal. i think it is reffering to the backup loader when it says illegal. if you install it dont update your wii via nintendo though.
